Terms of service

This English translation is provided for your convenience. Only the German version is legally binding.

1. Scope

These General Terms and Conditions apply to all orders placed by consumers via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Our online shop is aimed exclusively at consumers. Contracts with businesses are agreed individually outside the online shop.

2. Contracting party and conclusion of contract

The purchase contract is concluded with:

Robin Herwegh
trading as Robin Herwegh Commerce
Wolgaster Straße 12
13355 Berlin
Germany

VAT ID: DE367657355

The presentation of our products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

You can first add the products you want to your basket and change your details at any time before submitting the order using the correction options provided in the ordering process.

By clicking the final order button, you submit a binding offer to purchase the products in your basket. Immediately after submitting, you'll receive an automatic order confirmation by email. With this order confirmation, we accept your offer and the purchase contract is concluded.

3. Contract language and storage of the contract text

The language available for concluding the contract is German.

We store the data of your order. After completing your order, we will send you the order data and these General Terms and Conditions by email or provide them to you in a storable format.

You can optionally use a customer account. If you sign in with the email address used for your order, you can view your orders and their status there. The current General Terms and Conditions are available in our online shop at any time.

4. Products and personalisation

A significant proportion of our products are made individually according to your specifications. These may include, in particular, your name, your chosen route, your ride data, colours and other personal details.

Please check all details carefully before submitting your order. As a rule, we use the information you entered exactly as it was provided in the ordering process.

We are not responsible for errors in the finished product that are based solely on incorrect or incomplete information provided by you. Your statutory rights in the event of errors caused by us or other defects remain unaffected.

Product images are for illustration purposes. Colours may vary slightly depending on screen settings. With natural materials such as wood, there may be differences in colour, grain and texture. Such material-related differences do not constitute a defect.

5. Prices and shipping costs

All prices stated in the online shop are total prices and include statutory VAT.

We currently deliver within Germany only. Shipping within Germany is free of charge.

6. Delivery

We deliver by shipping only. Collection is not currently possible.

Delivery to a Packstation is possible, provided the shipping provider used for the order supports the chosen Packstation.

Each product is made individually for you and carefully checked before shipping. The regular production time is up to seven working days. When order volumes are particularly high, production may take up to three additional working days.

After completion, shipping within Germany usually takes one to three working days. The total delivery time is therefore a maximum of 13 working days.

For the purposes of this provision, working days are Monday to Saturday, excluding public holidays.

Shipping is mainly with DHL. Depending on the order and current workload, DPD or Hermes may also be used.

As soon as your order has been shipped, you'll receive a shipping confirmation with a tracking option.

7. Delivery address and failed delivery

You are responsible for providing a complete and correct delivery address in the ordering process. To support this, we use automatic address validation at checkout.

If you notice a mistake after ordering, please inform us without delay. As long as the order has not yet been shipped, we will try to correct the delivery address in time.

If an order cannot be delivered due to a delivery address that you culpably provided incorrectly or incompletely, we may charge you the costs actually incurred for the return and for any reshipment you request. We will inform you of the costs before reshipping.

The statutory shipping risk for consumer orders remains unaffected by this provision.

8. Payment methods

Depending on availability at checkout, the following payment methods are available in our online shop:

Credit card

You can pay with Visa, Mastercard or American Express. Your credit card will be charged once the order has been completed.

PayPal

To pay with PayPal, you need a PayPal account. After selecting this payment method, you'll be redirected to PayPal to log in and confirm the payment. The payment is processed via PayPal.

Apple Pay

To pay with Apple Pay, you must have set up Apple Pay on a supported device. The payment is confirmed via Apple Pay during the ordering process.

Google Pay

To pay with Google Pay, you must have set up Google Pay. The payment is confirmed via Google Pay during the ordering process.

Klarna

Depending on individual availability and approval by Klarna, the following payment methods in particular may be offered via Klarna:

– Klarna Pay later (invoice)
– Klarna Financing (instalments)
– Klarna Pay now (instant bank transfer)

When paying via Klarna, payment is processed directly between you and Klarna. Klarna's payment terms and conditions shown to you at checkout apply. The availability of individual Klarna payment methods may depend in particular on an identity, address or credit check by Klarna.

The payment methods shown in the specific ordering process are decisive.

9. Retention of title

The goods delivered remain our property until paid for in full.

10. Statutory warranty rights

The statutory warranty rights apply.

If a delivered product is damaged or defective, please contact us as soon as possible. Photos of the product and packaging help us to check your concern quickly. A lack of photos or a later notification does not limit your statutory warranty rights.

11. Voluntary guarantees

In addition to the statutory warranty rights, our voluntary 90-day satisfaction guarantee may apply to certain keepsakes.

The guarantee only applies to keepsakes expressly marked as participating. The full guarantee terms, in particular regarding duration, scope, returns and refunds, are provided on a separate information page and sent on a durable medium no later than upon delivery.

The statutory rights in the event of defects exist independently of the voluntary guarantee, can be exercised free of charge and are not limited by the guarantee.

12. Liability

We accept unlimited liability for claims arising from damage caused by us, our legal representatives or vicarious agents:

– in the event of injury to life, body or health,
– in the event of intentional or grossly negligent breach of duty,
– on the basis of an expressly agreed guarantee, or
– insofar as the scope of the German Product Liability Act applies.

In the event of a slightly negligent breach of material contractual obligations, our liability is limited to the damage that is foreseeable and typical for the contract at the time the contract was concluded. Material contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

Otherwise, claims for damages in the event of slightly negligent breaches of duty are excluded.

13. Contact and complaints

If you have any questions, problems with an order or complaints, you can contact us directly:

Robin: robin@moventerra.com
Marek: marek@moventerra.com

If a parcel arrives damaged or cannot be found despite being shown as delivered, please contact us within 14 days if possible. This request is not a cut-off period and does not limit your statutory rights.

14. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
